Two Paths to a Marriage Green Card
The right path depends on where your spouse currently lives and their immigration status.
Adjustment of Status (Spouse in the US)
If your spouse is already in the United States on a valid status, they may be eligible to adjust status to permanent resident without leaving the country.
- 1.File I-130 petition and I-485 application concurrently
- 2.Attend biometrics appointment
- 3.Apply for work permit (EAD) and travel document while waiting
- 4.Attend marriage green card interview
- 5.Receive green card approval
Consular Processing (Spouse Abroad)
If your spouse lives outside the United States, they will need to attend an immigrant visa interview at a U.S. Embassy or Consulate in their home country.
- 1.File I-130 petition with USCIS
- 2.Case transferred to National Visa Center (NVC)
- 3.Submit DS-260 immigrant visa application
- 4.Attend visa interview at U.S. Embassy
- 5.Enter the US as a permanent resident
Marriage Visa Categories
CR-1 Visa
Conditional Resident visa for spouses married less than 2 years at the time of admission. Requires removal of conditions after 2 years.
